These Terms of Service ("Terms") govern your access to and use of the VendMap mobile application (the "App") operated by Veriris LLC ("Veriris," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use immediately.

PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING VARIOUS LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE.

1. Definitions

"App" means the VendMap mobile application, including all features, functionalities, content, and services provided therein.
"Content" means all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials accessible through the App, including User Contributions.
"Basic Tier" means the ad-supported version of the App provided at no charge.
"Premium Tier" means the ad-free subscription version of the App, billed at the then-current rate.
"Pro Tier" means the subscription tier that includes pro dashboard functionality, billed at the then-current rate.
"Guest Mode" or "Guest User" means use of the App without creating an authenticated account, providing view-only access to vending machine locations and information.
"Services" means the services provided by Veriris through the App, including facilitating the sharing and location of Vending Machines.
"User," "you," or "your" means any person accessing or using the App.
"User Contributions" means any data, information, or content that a User submits, posts, uploads, or displays on or through the App, including VM locations, verifications, ratings, and issue reports.
"Vending Machine" or "VM" means any device dispensing products, the location of which is shared via the App.

2. Eligibility, Account Registration, and Guest Mode

Age Restriction: You must be at least 13 years of age (or 16 in the EEA/UK) to use the App in any mode (Guest or Authenticated). By using the App, you represent and warrant that you meet the applicable minimum age requirement. If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf.
Guest Mode: You may use the App without creating an account ("Guest Mode") subject to the restrictions described in Section 2.1. Guest Mode requires no registration but provides limited, view-only functionality.
Account Creation (Authenticated Mode): To access full App features (adding machines, rating, verifying, reporting), you must create an authenticated account via Google Sign-In or Apple Sign-In. Account creation is optional but required for interactive features.
Account Security: If you create an authenticated account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@veriris.com of any unauthorized use of your account. Guest users have no account credentials but are responsible for their device security.

2.1. Guest Mode and Feature Limitations

Guest Mode Availability: You may use the App in Guest Mode (without creating an account) to browse and view vending machine locations, ratings, and related information. Guest Mode does not require Google Sign-In, Apple Sign-In, or account registration.

Guest Mode Restrictions: Guest Mode is VIEW-ONLY. Guest users CANNOT:

Add new vending machine locations
Rate vending machines
Verify vending machine locations
Submit issue reports (out-of-stock, payment failures, etc.)
Submit status reports (working/broken)
Edit or correct vending machine information
Monitor vending machines
Access profile features or contribution history
Participate in community features requiring authentication

Guest Data and Privacy: Guest Mode uses minimal data collection. See our Privacy Policy for details on what data is collected from Guest users versus authenticated users.

No Guarantee of Guest Mode Availability: We reserve the right to modify, suspend, or discontinue Guest Mode at any time, in our sole discretion, without notice or liability. We may require account creation for continued use of the App.

Conversion to Authenticated Account: You may convert from Guest Mode to an authenticated account at any time by completing Google Sign-In or Apple Sign-In registration. Upon conversion, your guest consent preferences will be migrated to your authenticated account where technically feasible, and you will gain full access to App features.

Age Restrictions Apply: Even in Guest Mode, you must be at least 13 years of age (or 16 in the EEA/UK) to use the App, as specified in Section 2.

Guest Compliance with Terms: All other Terms of Service provisions apply equally to Guest users, including but not limited to: Acceptable Use (Section 12), Disclaimers (Sections 4, 10), Limitation of Liability (Section 11), Indemnification (Section 12), and Dispute Resolution (Section 14).

3. Subscriptions and Payments

Tiers: Veriris offers three tiers: Basic (ad-supported), Premium, and Pro.
Pricing: Subscription fees for Premium and Pro tiers are subject to change. We will notify you of any price changes at least 30 days in advance via email to your registered account and through a prominent in-app notification that you must acknowledge. Price changes will apply at your next subscription renewal after the notice period. If you do not agree to the new price, you may cancel your subscription before the renewal date through the app store.
Payment Terms: All payments are processed through third-party payment processors (Apple App Store, Google Play Store). You agree to abide by their terms and conditions. Veriris does not store, process, or have access to your payment information. Payment disputes, billing issues, or payment-related matters are governed by the payment processor's terms and policies.
Refunds: All payments are processed by third-party app stores and are subject to their refund policies. Generally, payments are non-refundable unless required by applicable law or the app store's refund policy. For refund requests, contact the app store directly.
Monetization Model: Our monetization is based on advertising (Basic Tier) and subscription fees (Premium/Pro Tiers). We do not provide financial rewards or incentives for user contributions. This design prevents incentivizing the creation of inappropriate content.

4. Location Data and VM Disclaimer

Location Data Collection and Sharing: By using the App, you acknowledge and agree that:
- Your device location may be used to display nearby vending machines and calculate distances.
- When you add a vending machine, the location coordinates are stored in our database as part of the community map.
- Your location data may be shared with mapping service providers (such as Google Maps) to provide location-based functionality.
- You can control location permissions through your device settings, but limiting location access may reduce App functionality.
User-Submitted Locations: VM locations displayed in the App are submitted by users and may be approximate. Users may manually adjust locations or estimate placement. Veriris does not independently verify VM coordinates and does not guarantee that a VM exists at any marked location, even if verified by other Users.
Community-Driven Data: You acknowledge that the App is community-driven; data accuracy depends entirely on User Contributions. Veriris does not verify the accuracy, completeness, or reliability of any User Contributions.
No Operation or Maintenance: Veriris is NOT an operator, owner, servicer, or maintainer of any Vending Machine. We merely provide a platform for Users to share and locate potential VM sites.
No Liability for VM Issues: ANY AND ALL ISSUES WITH PAYMENT ACCEPTANCE, PRODUCT AVAILABILITY, PRODUCT QUALITY, MECHANICAL OPERATION, HYGIENE, SAFETY, LEGAL COMPLIANCE, PRICING, OR ANY OTHER ASPECT AT A VM ARE SOLELY BETWEEN YOU AND THE VM OPERATOR. Veriris explicitly disclaims all liability for such issues, damages, or losses arising therefrom. Your use of any VM located via the App is entirely at your own risk.

5. User Contributions

Submission: Authenticated Users Only: Users with authenticated accounts may add new VM locations, verify existing ones, rate VMs (1–5 stars), and report issues (e.g., out-of-stock, payment failures). Guest users cannot submit User Contributions of any kind.

No Endorsement: User Contributions do not constitute endorsements by Veriris, nor do they guarantee accuracy, completeness, or operator engagement. While Veriris is not obligated to monitor all User Contributions, we reserve the right to review and moderate content as described in Section 5.1.

Content Standards: You agree that your User Contributions will not:

Be false, inaccurate, misleading, or fraudulent.
Infringe upon any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy.
Violate any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising).
Be defamatory, libelous, unlawfully threatening, or unlawfully harassing.
Be obscene or contain pornography.
Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
Create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

5.1 User Generated Content Moderation

Content Standards: All User Contributions must comply with these content standards and may not be false, inaccurate, misleading, fraudulent, violate any applicable laws or regulations, target or harm minors, or promote illegal activities or dangerous behavior.
Moderation: Veriris may review, moderate, and remove User Contributions that violate these standards or applicable laws. We will notify you via email if your content is removed and provide the reason. You may appeal content removal decisions by contacting support@veriris.com within 14 days. We are not obligated to monitor all User Contributions but will investigate reported content within 7 business days.
Reporting System: Users can report inappropriate content through the in-app reporting system. We will investigate and take appropriate action.
Age Verification: Users must be at least 13 years old to contribute content. Users under 18 must have parental consent.
Content Rating: This app contains user-generated content (VM locations, ratings, and reports) that is suitable for all audiences.

5.2 Reporting and Blocking

In-App Reporting: Users can report inappropriate content or behavior through the app's reporting system.
User Blocking: Users can block other users to prevent further interaction.
Content Removal: We reserve the right to remove content that violates our standards.
Account Actions: We may suspend or terminate accounts that repeatedly violate our policies.

6. Data Collection and Analytics

Crash Logs and Diagnostics: The App automatically collects crash logs, diagnostics, and performance data when errors occur. This includes error messages, stack traces, device information, platform version, memory usage, network errors, and performance metrics. This data is shared with Firebase Crashlytics and Firebase Analytics for crash reporting, analytics, and troubleshooting.
Analytics Data: The App collects analytics data including user interactions, screen views, and app usage patterns. This data is shared with Firebase Analytics and Google AdMob for analytics and advertising purposes.
Consent: By using the App, you consent to the automatic collection and sharing of crash logs, diagnostics, and analytics data with third-party service providers as described in our Privacy Policy.

7. Third-Party Brands, Content, and Services

Third-Party Marks: The App may reference or display trademarks, logos, or brands (e.g., Coca-Cola®, Pepsi®, Pokémon®, Nintendo®). These third-party marks are owned by their respective rights holders. Veriris does not claim any affiliation with, sponsorship by, or endorsement from these entities.
Third-Party Services: The App uses third-party services including Google Maps API, Google Geolocation API, Firebase Crashlytics, Firebase Analytics, and Google AdMob. By using the App, you agree to comply with the terms of service and privacy policies of these third-party providers. Veriris assumes no liability for third-party data accuracy, availability, privacy practices, or any issues arising from your use of such third-party services.
Links to Other Websites: The App may contain links to third-party websites or services that are not owned or controlled by Veriris. Veriris has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Veriris shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

8. Intellectual Property

Veriris Property: All App content (including but not limited to code, graphics, text, layout, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code), and the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Content, contained in the App is owned, controlled, or licensed by or to Veriris, and is protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.
Limited License: You may use the App and its Content only as permitted under these Terms; no other rights or licenses are granted.
User Content Ownership: You retain ownership of any intellectual property rights you hold in your User Contributions.

9. License to User Content

By submitting User Contributions, you grant Veriris a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Contributions in connection with the App and related marketing, promotion, and development, in any media formats and through any media channels now known or hereafter developed. This license will continue for a commercially reasonable period after account deletion to allow for cached content, backup systems, and derivative works already created, but you may request complete removal of your identifiable contributions by contacting support@veriris.com.

10. Disclaimers of Warranties

"AS IS" and "AS AVAILABLE": THE APP AND ALL CONTENT, SERVICES, AND FEATURES AVAILABLE IN OR THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
No Guarantees: VERIRIS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. VERIRIS DOES NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE.
No Responsibility for User Contributions: VERIRIS IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE APP.

11. Limitation of Liability

Maximum Extent Permitted by Law: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VERIRIS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF VERIRIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
ANY CONTENT OBTAINED FROM THE APP;
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
ANY ISSUES, FAILURES, OR MALFUNCTIONS OF ANY VENDING MACHINE OR PRODUCTS OBTAINED THEREFROM, REGARDLESS OF WHETHER SUCH VM WAS LOCATED VIA THE APP;
ANY VIRUSES, BUGS, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY;
ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE APP.

Total Aggregate Liability: IN NO EVENT SHALL THE AGGREGATE LIABILITY OF VERIRIS FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID VERIRIS, IF ANY, IN THE LAST TWELVE (12) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Veriris, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

Your access to or use of the App;
Your User Contributions;
Your violation of these Terms;
Your violation of any rights of another, including without limitation any intellectual property right, privacy right, or property right;
Your interaction with any Vending Machine that you located through the App;
Any dispute or issue between you and any third party.

Guest User Indemnification: Guest users are bound by this indemnification obligation despite not having an authenticated account. By using the App in Guest Mode, you agree to defend, indemnify, and hold harmless Veriris under the same terms as authenticated users. Because Guest users cannot submit User Contributions, the indemnification obligation for "Your User Contributions" does not apply to Guest users.

13. Termination

By Veriris: We may terminate or suspend your access to the App for violation of these Terms, illegal activity, fraudulent behavior, abuse of the App or other users, security threats, or other conduct harmful to Veriris or the community. For Basic Tier users, termination may be immediate. For paid subscribers, we will provide at least 14 days' notice before termination unless immediate termination is necessary due to: (a) violation of law or court order; (b) credible security threat to the App or other users; (c) repeated violations of these Terms after prior warning; or (d) fraudulent activity. In cases of immediate termination, we will provide explanation within 24 hours. Refunds for paid subscriptions are subject to the app store's refund policy.
By You: You may terminate your account at any time by deleting it through the App settings. Account deletion is immediate and irreversible. Refunds are subject to the app store's refund policy.
Effect of Termination: Upon termination, your right to use the App will immediately cease. Your personal data will be handled according to our Privacy Policy.
Guest Mode Termination: For Guest users, termination occurs when you:
- Uninstall the App (permanent termination of local guest data)
- Clear app data or cache (reset of guest session)
- Convert to an authenticated account (termination of guest status, continuation as authenticated user)
We may also terminate or suspend Guest Mode access for all users or specific guest devices at any time, for any reason, including but not limited to suspected abuse, violation of these Terms, or discontinuation of Guest Mode functionality. Because Guest users are not identifiable, individual termination of specific guest users is not feasible.
Survival: All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, warranty disclaimers, indemnity for actions taken before termination, and limitations of liability. The license to User Contributions in Section 9 will continue as specified in that section.

14. Governing Law and Dispute Resolution

Governing Law: These Terms will be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law principles.
Informal Dispute Resolution: Before filing a formal claim, you agree to contact us at support@veriris.com to attempt informal resolution. We will work in good faith to resolve disputes within 60 days.
Binding Arbitration: If informal resolution fails, any dispute arising from or relating to these Terms or the App will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in King County, Washington, or remotely via video conference at your option. Judgment on the arbitration award may be entered in any court with jurisdiction.
NO CLASS OR REPRESENTATIVE ACTIONS: YOU MAY ONLY RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS, AND MAY NOT BRING A CLAIM AS A PLAINTIFF OR A CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. CLASS ARBITRATIONS, CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED.
Class Action Waiver Severability: If any court or arbitrator determines that the class action waiver set forth in this section is void or unenforceable for any reason, or that an arbitration can proceed on a class basis, then the arbitration provisions set forth above shall be deemed null and void in their entirety and the parties shall be deemed to have not agreed to arbitrate disputes. However, if only a portion of this class action waiver is found unenforceable, the remainder of the class action waiver and all other provisions of these Terms shall remain in full force and effect.
Class Action Waiver Survival: The class action waiver set forth above shall survive and remain in full force and effect even if you opt out of the arbitration agreement pursuant to the Arbitration Opt-Out provision. If you opt out of arbitration, you still agree that any court proceeding must be brought on an individual basis only and not as a class, consolidated, or representative action.
Arbitration Opt-Out: You may opt out of arbitration by emailing support@veriris.com within 30 days of first accepting these Terms. Include your name, email, and a clear statement: "I opt out of arbitration." If you opt out, disputes will be resolved in state or federal courts in King County, Washington, and you consent to personal jurisdiction.
Arbitration Costs and Fees: Each party shall bear its own attorney's fees, costs, and expenses in any arbitration proceeding, unless the arbitrator awards fees as provided below. Veriris will pay all arbitration filing fees and administrative costs for claims under $10,000. For claims over $10,000, arbitration costs shall be allocated according to AAA rules. The prevailing party in any arbitration may be awarded reasonable attorney's fees and costs at the arbitrator's discretion.
Expedited Arbitration: For claims seeking less than $25,000, the parties agree to use AAA's Expedited Procedures. Discovery shall be limited to the exchange of relevant documents and a maximum of two depositions per party, each not to exceed four hours, unless the arbitrator determines additional discovery is necessary for a fair resolution.
Frivolous Claims and Bad Faith: If the arbitrator finds that either party filed a claim or defense that was frivolous, brought in bad faith, or for the purpose of harassment, the arbitrator may award the prevailing party reasonable attorney's fees and costs incurred in defending against such claim. A claim or defense is considered frivolous if it is objectively baseless and has no reasonable chance of success under existing law.
Small Claims Court Exception: Either party may bring a claim in small claims court if it qualifies, regardless of arbitration.
Injunctive Relief Exception: Either party may seek court injunctions to prevent intellectual property infringement or unauthorized use of the App.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Veriris regarding your use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
Waiver: No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Veriris to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Veriris may assign its rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, provided that the assignee agrees to honor these Terms and our Privacy Policy.
Force Majeure: Veriris will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, or materials. If such delay or failure continues for more than 30 consecutive days, you may terminate your subscription and receive a pro-rated refund for any unused subscription period.
App Store Terms: You acknowledge and agree that the availability of the App is dependent on the third party from whom you received the App license, e.g., the Apple App Store or Google Play Store ("App Store"). You agree to comply with all applicable terms and conditions of the respective App Store when using the App.
Third-Party Beneficiaries: Veriris and its affiliates are third-party beneficiaries of these Terms and may enforce them directly against users.

16. Changes to Terms

Veriris may modify these Terms from time to time. For material changes (such as changes to payment terms, dispute resolution, warranties, or liability), we will provide notice through the App or by other appropriate means before the changes take effect. For non-material changes, we may update these Terms without prior notice and will update the "Last updated" date at the top of these Terms.

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to material changes, discontinue use before the effective date.

18. Platform-Specific Terms

The following additional terms apply based on where you downloaded the VendMap application:

18.1 iOS App (Apple App Store)

If you downloaded VendMap from the Apple App Store, the following terms apply:

Acknowledgement: These Terms are concluded between you and Veriris LLC only, and not with Apple, Inc. ("Apple"). Veriris, not Apple, is solely responsible for the VendMap application and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
Scope of License: Subject to these Terms, Veriris grants you a limited, non-transferable license to use the VendMap application on any Apple-branded products that you own or control and as permitted by the App Store Usage Rules. The VendMap application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and Support: Veriris is solely responsible for providing any maintenance and support services for the VendMap application, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the VendMap application.
Warranty and Refunds: Veriris is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed herein. In the event the VendMap application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the VendMap application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Veriris's sole responsibility.
Product Claims: You acknowledge that Veriris, not Apple, is responsible for addressing any claims by you or any third party relating to the VendMap application or your possession and/or use of the application, including, but not limited to: (i) product liability claims; (ii) any claim that the VendMap application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the VendMap application's use of HealthKit and HomeKit frameworks (if applicable).
Intellectual Property Claims: You acknowledge that, in the event of any third-party claim that the VendMap application or your possession and use of the application infringes that third party's intellectual property rights, Veriris, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties, including the Treasury Department's Specially Designated Nationals List or the Commerce Department's Denied Persons List or Entity List.
Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with respect to the iOS application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Third-Party Terms of Agreement: When using the VendMap application, you must comply with applicable third-party terms of agreement, including but not limited to your wireless data service agreement.

18.2 Android App (Google Play Store)

If you downloaded VendMap from the Google Play Store, the following terms apply:

Distribution and License: The VendMap Android application is distributed through Google Play Store. Google LLC acts as an agent to make the application available but does not undertake an obligation to monitor the application or its content. Upon download, you receive a non-exclusive, worldwide, and perpetual license to use the VendMap application on your Android devices.
Family Sharing: You may share VendMap with other family members in your Google Play family group, subject to Google Play's limitations and policies.
Refunds: Google may issue refunds to users in accordance with Google Play refund policies. All refund requests for purchases made through Google Play must be directed to Google. Veriris is not responsible for processing refunds for purchases made through Google Play. Google may deduct any refund amounts from payments owed to Veriris.
Support Obligations: Veriris is solely responsible for providing customer support for the VendMap application. We will respond to customer support inquiries within 3 business days.
Product Removal and Refunds: If VendMap is removed from Google Play due to a legal takedown and you purchased the application within one year (or longer as required by local consumer law) before the date of takedown, Veriris will refund to you all amounts paid for the application. Upon such removal, you will no longer have the right or ability to reinstall the affected application.
Google's Disclaimer: Google Play is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Google expressly disclaims all warranties and conditions of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Google will not be responsible for, and will not have any liability whatsoever under, these Terms or your use of VendMap.
Google's Limitation of Liability: Google, its subsidiaries and affiliates, and its licensors will not be liable under any theory of liability for any indirect, incidental, special, consequential, or exemplary damages that may be incurred by you, including any loss of data, whether or not Google or its representatives have been advised of or should have been aware of the possibility of any such losses arising.
EULA Relationship: To the extent that these Terms conflict with the Google Play Developer Distribution Agreement, the Developer Distribution Agreement will supersede these Terms. Google is not responsible for and has no liability under these Terms.
